These Terms and Conditions govern the use of this website and all purchases made from Newtons Pharmacy ("we", "us", "our").

By accessing this website or placing an order, you agree to be bound by these Terms and Conditions.


1. Orders and Acceptance

All orders placed through our website are subject to review, confirmation, acceptance, and availability.

We reserve the right to:

  • refuse any order;
  • limit quantities purchased;
  • cancel any order due to pricing errors, stock discrepancies, regulatory requirements, or other reasonable circumstances;
  • request additional information before processing an order.

A contract of sale is formed only when we confirm acceptance of your order.


2. Product Availability

While we endeavour to maintain accurate stock levels and product information, occasional discrepancies may occur.

Products displayed on our website may:

  • become unavailable without notice;
  • be discontinued;
  • have changed packaging, formulation, size, or appearance;
  • be temporarily out of stock.

If an item becomes unavailable after purchase, we may:

  • offer a substitute product;
  • place the item on backorder;
  • provide a store credit; or
  • provide a refund.

3. Pricing and Payment

All prices are displayed in Australian Dollars (AUD) unless otherwise stated.

Prices may change without notice.

Despite our best efforts, pricing errors may occasionally occur. If an error is identified, we reserve the right to cancel the order and provide a full refund.

Customers are responsible for all applicable taxes, duties, customs charges, and import fees imposed by their local authorities.

Payment must be received and cleared before goods are dispatched.

We accept only the payment methods displayed during checkout.


4. Security of Payment Information

Our website uses industry-standard encryption technologies to protect customer information.

Credit card transactions are processed through secure payment gateways.

Newtons Pharmacy does not store complete credit card details on its systems.

While we take reasonable precautions, no internet transmission can be guaranteed completely secure. Customers provide information at their own risk.


5. Customer Accounts

Customers are responsible for maintaining the confidentiality of their account credentials.

You are responsible for all activities conducted under your account.

We reserve the right to suspend, restrict, or terminate accounts at our discretion.


6. Product Information and Images

Images displayed on this website are for illustrative purposes only.

Actual products may vary in:

  • packaging;
  • colour;
  • labelling;
  • appearance;
  • manufacturer presentation.

Descriptions are provided in good faith but may contain errors or omissions.

Traditional herbal information, homeopathic information, and educational content are provided for informational purposes only and should not be interpreted as therapeutic claims unless specifically stated.


7. Compounded Medicines and Custom-Made Products

Many products supplied by Newtons Pharmacy are individually prepared, compounded, customised, or manufactured specifically for a customer.

Due to their personalised nature:

  • compounded products cannot be returned for change of mind;
  • compounded products cannot be exchanged;
  • compounded products cannot be refunded once prepared unless required by law.

Customers are responsible for ensuring all information supplied for compounding is accurate before the product is prepared.


8. Shipping and Delivery

Orders are generally dispatched through Australia Post or other carriers selected by Newtons Pharmacy.

Estimated delivery timeframes are provided as guides only and are not guaranteed.

We are not responsible for delays caused by:

  • postal services;
  • courier services;
  • customs authorities;
  • weather events;
  • industrial action;
  • public holidays;
  • incorrect addresses provided by customers;
  • events beyond our reasonable control.

Risk in goods passes to the customer upon delivery.


9. Proof of Dispatch

Where tracking information is available, dispatch and delivery records provided by the carrier will constitute evidence that an order was shipped.

Customers must ensure delivery addresses are correct and secure.

Newtons Pharmacy is not liable for theft, loss, or damage occurring after delivery has been confirmed by the carrier.


10. Delivery Investigations and Record Retention

Customers must notify us of missing, damaged, incorrect, or incomplete orders within:

  • 3 business days of receipt for damaged or incorrect goods; and
  • 14 days of the expected delivery date for non-delivery claims.

Due to practical limitations, shipping records, carrier records, and order documentation may not be retained indefinitely.

Claims relating to deliveries made months or years earlier may be impossible to verify and may therefore be declined where supporting evidence is unavailable.

Customers acknowledge that investigations become increasingly difficult with the passage of time and that Newtons Pharmacy cannot reasonably be expected to reconstruct historical delivery events beyond normal record-retention periods.

10A. Customer Duty to Inspect and Notify

Customers are responsible for inspecting all goods promptly upon delivery and confirming that the order has been received complete and in satisfactory condition.

Any claim relating to:

  • missing items;
  • incorrect items supplied;
  • shortages;
  • damaged goods;
  • defective goods;
  • packaging concerns; or
  • delivery discrepancies,

must be reported to Newtons Pharmacy within a reasonable period after delivery and, where possible, supported by photographs or other relevant evidence.

Customers acknowledge that the accuracy and reliability of investigations may diminish over time due to the routine destruction, archiving, or unavailability of records maintained by Newtons Pharmacy, Australia Post, couriers, suppliers, payment processors, and other third parties.

Failure to notify Newtons Pharmacy of a delivery discrepancy within a reasonable period may adversely affect our ability to investigate the matter and may result in a claim being declined where sufficient evidence is no longer available.

To assist with prompt resolution of any issue, customers are encouraged to retain:

  • the original packaging;
  • shipping labels;
  • invoices;
  • tracking information; and
  • photographs of any damaged or incomplete delivery.

Nothing in this clause excludes, restricts, or modifies any rights or remedies available under the Australian Consumer Law.


11. Refunds and Returns

Your rights under Australian Consumer Law are not excluded by these Terms and Conditions.

Where a product:

  • is faulty;
  • is damaged in transit;
  • does not match its description; or
  • fails consumer guarantees under Australian Consumer Law,

you may be entitled to a repair, replacement, refund, or other remedy.

Photographic evidence may be requested before a claim is assessed.

We do not normally provide refunds for:

  • change of mind;
  • incorrect product selection by the customer;
  • products no longer required;
  • opened products;
  • used products;
  • perishable products;
  • custom-made or compounded products.

At our discretion, unopened manufacturer-sealed products may be accepted for return within 10 days of purchase, provided they remain suitable for resale.

Return postage costs are generally the responsibility of the customer unless required otherwise by law.

 

11A. Historical Orders

Newtons Pharmacy maintains business records in accordance with applicable legal and operational requirements. While reasonable efforts are made to retain relevant records, shipping documentation, parcel lodgement records, tracking information, CCTV footage, supplier records, and other evidence may not be available indefinitely.

Customers acknowledge that claims relating to transactions occurring many months or years earlier may be impossible to verify fairly and accurately.

Where independent evidence is no longer available due to the passage of time, Newtons Pharmacy reserves the right to determine such claims based on the information reasonably available at the time of the investigation.

The absence of historical records shall not, by itself, be taken as evidence that goods were not supplied, delivered, collected, or received.


12. International Orders

Customers are solely responsible for ensuring products can legally be imported into their country.

Newtons Pharmacy does not guarantee that products will clear customs in any jurisdiction.

No refund will be provided for:

  • customs seizure;
  • customs destruction;
  • import restrictions;
  • customs delays;
  • regulatory refusal;

unless the returned goods are actually received back by Newtons Pharmacy and remain suitable for resale.

Original shipping charges are non-refundable.


13. Prescription Medicines

Prescription medicines may only be supplied where permitted by Australian law.

Valid prescriptions may be required before supply.

We reserve the right to refuse supply where legal, clinical, or professional concerns arise.


14. Privacy

Personal information is collected and handled in accordance with our Privacy Policy and applicable privacy legislation.

Information is used only for:

  • processing orders;
  • providing services;
  • meeting legal obligations;
  • communicating with customers.

We do not sell customer information to third parties.


15. Intellectual Property

All content on this website, including:

  • text;
  • images;
  • graphics;
  • logos;
  • product descriptions;
  • downloadable material;

remains the property of Newtons Pharmacy or its licensors.

No material may be copied, reproduced, published, or distributed without prior written permission.


16. Limitation of Liability

To the fullest extent permitted by law:

  • Newtons Pharmacy excludes liability for indirect, incidental, consequential, special, or economic loss;
  • liability is limited to the value of the product purchased;
  • we are not liable for losses resulting from misuse of products, incorrect self-diagnosis, failure to seek professional advice, postal delays, or events beyond our reasonable control.

Nothing in these Terms excludes rights that cannot legally be excluded under Australian Consumer Law.


17. Dispute Resolution

If a customer has a concern regarding an order, product, or service, they should contact Newtons Pharmacy directly as soon as possible.

Both parties agree to make reasonable efforts to resolve disputes amicably before commencing formal proceedings.

Nothing in this clause limits any rights available under Australian Consumer Law or through NSW Fair Trading.


18. Changes to Terms

These Terms and Conditions may be amended at any time without notice.

The version published on the website at the time an order is placed will apply to that order.


19. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

Any disputes arising from the use of this website or the purchase of goods shall be subject to the jurisdiction of the courts of New South Wales.
